Are marriages headed for an overhaul? People are redefining the way forward for marriage. Depending upon how long one lives, ‘Till death do us part’ seems like a much bigger challenge than it used to be. More and more couples are considering entering into a marriage contract or Prenups before getting hitched. Having a prenup can be a good idea as it would protect the interests of both parties and can also help you steer away from unforeseen circumstances and exorbitant divorce settlements.

- Each party should put enough emphasis on speaking with their Family law lawyer to obtain independent legal advice.
- Each party needs to be aware of their rights and obligations, and have a lawyer advocating for their best interests while negotiating the terms of said contract.
- If you intend to enter into a marriage contract, have this discussion with your soon-to-be spouse well in advance of getting married. Planning a wedding is stressful enough and negotiating the terms of a marriage contract at the same time is not advisable(doesn’t sound romantic).
- Ideally, it is best to enter into a cohabitation agreement before moving in with your partner. This cohabitation agreement can then provide for the parties’ intentions upon marriage.
- Be transparent and frank with each other and exchange financial disclosures. One of the main reasons a domestic contract(or a provision in it) is set aside is if a party failed to disclose to the other, significant assets/debts existing when the domestic contract was made.
At the end of the day, only wedded bliss can save us from legal hassles. But adding a prenup to your pre-marriage to-do list can help avoid post-marital trauma!
